Supreme Court overrules Allahabad High Court order that had quashed UP Board of Madarsa Education Act [5.11.2024]

In a landmark verdict, the Supreme Court held that States are not empowered under the Constitution to take over all privately-owned resources for distribution to serve the "common good."

The bench, however, stated that  States can stake claim over private properties in certain cases.

The top court observed that all private properties are not material resources. Hence, these cannot be taken over by the State. 

The nine-judge bench delivered the judgment on the issue with an 8-1 majority.
